Small Business Relief UAE Corporate Tax: Extended to 2029, Eligibility and How to Elect

Small business relief UAE corporate tax rules have changed again, and this time the change is good news for smaller companies. The relief now applies to tax periods ending on or before 31 December 2029. Here’s what it does, who can use it, and how to claim it without missing a deadline.

Overview of Small Business Relief

Small business relief, often called SBR, lets an eligible business choose to be treated as having no taxable income for a tax period. You skip the full calculation of taxable income, adjustments, and deductions, and the corporate tax for that year becomes zero. It works as a shortcut, but only if you meet the conditions and make the election.

Recent Amendment: Extension to 31 December 2029

The UAE has extended SBR to tax periods ending on or before 31 December 2029. The previous cut-off was 31 December 2026, so the relief now runs three years longer. The extension was made under Ministerial Decision No. 131 of 2026. The AED 3 million revenue threshold has not changed.

The extension does not make the relief automatic. You still need to be registered for corporate tax, file your return, and keep proper records. Each year, you have to choose the relief on your return.

Eligibility Requirements

You can use SBR if you are a resident business and your revenue for the tax period is AED 3 million or less. Revenue here means the figure reported under the accounting standards you use, not your profit after expenses. Qualifying Free Zone Persons cannot elect SBR. Neither can members of multinational groups whose consolidated revenue is above AED 3.15 billion.

Applying the Revenue Threshold Across Tax Periods

The AED 3 million limit is tested across periods, not just the one you are filing. Staying under the threshold in one year does not guarantee relief next year. Look at your revenue for earlier periods as well. If revenue went above AED 3 million in a previous period, you cannot use SBR in the periods that follow, even if your revenue has since dropped.

A Real Example

Consider a two-person design studio in Dubai. In its first tax period, revenue came to AED 2.4 million. The owner checked the conditions, elected SBR on the return, and reported no corporate tax for the year. The next year, a large contract pushed revenue to AED 3.4 million. The studio was no longer eligible, so it had to work out its tax the normal way. For taxable income of AED 600,000, the tax is AED 20,250, with 0% on the first AED 375,000 and 9% on the remaining AED 225,000.

The owner’s lesson was simple. Track revenue every month, not just at year end. A contract that arrives late in the year can change your eligibility for the next period.

How to Elect

Start by confirming that you are registered for corporate tax. If you are not, register before anything else, because you cannot elect without a registration.

Next, check your revenue for the tax period and for every earlier period. Keep the accounting records that support those figures, since the Federal Tax Authority can ask for them later.

When you file your corporate tax return on EmaraTax, select the small business relief election. You have to make the election within the standard nine-month filing window after the tax period ends. Once that deadline passes, you cannot go back and claim it.

Limitations and Compliance Obligations

SBR does not remove your other obligations. You still register, file a return for every tax period, and maintain accurate books. It is also not the same as the standard 0% rate on the first AED 375,000 of taxable income. Those are separate rules, and it helps to understand both before you decide.

Being eligible and choosing the relief are two different questions. Some businesses qualify but still gain more from the normal calculation, especially if they have large deductible costs. Compare the two outcomes before you elect.

Common Errors to Avoid

The most common error is assuming the relief applies automatically. It does not. Another is treating revenue and taxable income as the same figure, which they are not. Some businesses also forget to look back at earlier periods, and that is how a business ends up electing when it should not.
